TCIP, which stands for "Natural Disaster Insurance Pool", was established in 2000 to prevent a repeat of the large-scale losses caused by the August 17, 1999 earthquake in Gölcük. TCIP insurance is compulsory for all home and workplace owners.
First of all, it is checked whether the house to be purchased has a title deed and whether it has been transferred to condominium ownership. It is checked whether there is a mortgage, lien or a restrictive situation in the title deed records of the house to be obtained from the Land Registry Office of the region to which the house belongs. If there is a district / municipality to which the house belongs, its status in the plans and the geological structure of the region are learned by specifying the plot, island, parcel numbers of the house to be taken from the metropolitan municipality. When the information is completed, the sale is realized through the title deed. Notary sales are not valid in the land registry.
If the owner of the real estate needs to use the property, he/she may notify the tenant with a notice within one month from the date of purchase and may file an eviction action against the tenant within 6 months from the date of purchase.
The new purchaser of this property takes over all the provisions of the contract between the former owner and the tenant. Therefore, at the end of the lease agreement, he/she has the right to file a lawsuit on grounds of need. However, if this period is long, the law provides a period of 6 months for the eviction of the tenant without waiting for this period and stipulates that an eviction lawsuit can be filed at the end of this period. For this, the new owner of the dwelling must notify through a notary public within one month from the date of purchase of the real estate that he/she has purchased this place and that he/she needs the dwelling and therefore the eviction is requested.
If the land is shared, it is not possible to determine the share purchased on the land subject to common ownership. If a parcelization plan has been made, it is possible to determine the person to whom the parcel was sold by notarizing the parcel on the sketch.
Settlements with a population exceeding 10,000 in the last census are required to have zoning plans. In settlements where the population does not exceed 10,000 in the last census, the municipal council decides whether it is necessary to make a zoning plan.
